Client terms

How we collect, use and protect your information
Tinker Tank (Pty) Ltd ("us", "we", or "our") owns and operates the following websites; tinkertank.co.za; ystationery.com; bbox.co.za; wearupon.co.za; collectively defined as the "Service". This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our service and the choices you have associated with that data.

We use your data to provide and improve the service
By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Information collection and usage
We collect several different types of information for various purposes to provide and improve our Service to you.
Types of Data Collected. Personal Data. While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but not limited to:

• Identity Document number
• Email address
• Phone number
• Cookies and Usage Data

Usage data
We may also collect information on how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Tracking & cookies data
We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Transfer of data
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside Republic of South Africa and choose to provide information to us, please note that we transfer the data, including Personal Data, to Republic of South Africa and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Tinker Tank will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Service providers
We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related or to assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics
We may use third-party Service Providers to monitor and analyze the use of our Service.

Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. Links to other sites
Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Children's Privacy. Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Privacy policy

Tinker Tank promises to treat all your personal information carefully and responsibly.
- Personal information includes but is not limited to any information that lets Tinker Tank identify you, such as your name/s and surname combined with your physical address, contact details and/or passport/identity number.
- Personal information (in South Africa) also refers to the personal information that uniquely identifies a legal entity, such as the trading name of a company and company registration number.
- Special personal information includes information about your race or ethnic origin, religious and philosophical beliefs, political persuasion, biometric information (for example, your voice or fingerprints).
- Personal information may be given to or collected by Tinker Tank in writing as part of a written application form, electronically (email), telephonically, online (tinkertank.co.za or bbox.tinkertank.co.za or huiswerk.tinkertank.co.za or wearupon.tinkertank.co.za) or via the Tinker Tank Compliance App.
- Processing of personal information includes any initial processing that Tinker Tank does when we first collect your personal information. It also includes any further and ongoing processing that Tinker Tank is allowed to carry out legitimately in terms of the reasons listed in clause 1. The term ‘processing’ includes collecting, using, altering, merging, linking, organising, disseminating, storing, retrieving, disclosing, erasing, archiving, destroying or disposing of personal information.
- Tinker Tank will only collect and process your personal information for the reason you provided, or to enable us to comply with the requirements of specific local or foreign laws that we are governed by; or to comply with any regulations, directives, judgments or court orders, government sanctions or embargoes, reporting requirements under financial transactions legislation, and demands of any supervising authority, regulator, tribunal, enforcement agency or exchange body.
- Clause 1: Tinker Tank may process your personal information to protect you or our legitimate interest. Your personal information includes, but is not limited to information from registration agencies to determine which companies are owned by you. Tinker Tank will not collect and process personal information about you that we do not need. The general purposes for which Tinker Tank collects and processes your personal information include:
1.1. Creating a record of you on our system to verify your identity, assess your application for products and/or services, provide you with the products and/or services you have applied for or enquired about, and then communicate with and keep you informed about these products and/or services.
1.2. Assessing whether you qualify for a discount or partial payments.
1.3. Providing discretionary and administrative compliance services.
1.4. Managing our business and identifying potential trends within the market, to ensure our products are future-fit.
1.5. Enforcing our obligations, including without limitation the collection of amounts outstanding from you and your provision of security for banking facilities.
1.6. Further processing for historical, statistical or research purposes where the outcomes will not be published in an identifiable format.
1.7. Conducting analytics operations to better understand you as our customer so that we can tailor our product and/or service offerings to you, where relevant and applicable.
1.8. Conducting surveys to gauge customer or employee sentiment or to improve our product and service offering.
1.9. Where you have applied for employment at Tinker Tank we perform applicant screening and background checks, and such screening may include social media screening and screening relating to any information about you obtained from publicly available sources such as search engine results.
1.10. Where you are a Tinker Tank employee (including contractors), we create an employment record of you on our system to facilitate continuous monitoring during your employment with us.

1.11. Where you are a supplier to Tinker Tank, we process your personal information for due diligence, risk assessment, administrative and payment purposes.
- Furthermore, Tinker Tank will not process your special personal information unless:
- You have consented to Tinker Tank processing it (in circumstances where we are legally obliged to obtain your consent); or
- It is necessary to exercise or defend a right or obligation in law; or
- It is necessary to comply with an international legal obligation of public interest; or
- It is for certain historical, research or statistical purposes that would not adversely affect your privacy; or
- You have deliberately made your personal information public.

There are some personal information fields that you have to fill in or provide if you want Tinker Tank to provide you with your chosen product and/or service or onboard you as an employee, supplier or job applicant. This information can be provided in writing, electronically or telephonically, but it must be accurate and complete. These fields are indicated by an asterisk (or as otherwise indicated) on the respective forms/websites. If Tinker Tank does not receive the necessary personal information, we will not be able to continue with your application. If you are already a(n) customer/employee/supplier and Tinker Tank asks you for this information and you do not provide it, Tinker Tank will have to suspend the provision of the product and/or services for a period of time, or as the case may be, even terminate our relationship with you.
- In most cases, personal information will be collected directly from you, but there may be other instances when Tinker Tank will collect personal information from other sources. These may include public records, places where you may already have made your personal information public (for example, on social media where your settings on such social media are set to ‘public’). Tinker Tank will only collect your personal information from other sources where we are legally entitled or obliged to do so, and you are entitled to ask Tinker Tank which sources Tinker Tank used to collect your personal information.

- For the purposes outlined in paragraph 9 (above), Tinker Tank will, in most instances, collect and process your personal information internally. However, there are times when Tinker Tank needs to outsource these functions to third parties, including parties in other countries. Where your personal information is shared internally within Tinker Tank such sharing will be carried out only for the purposes outlined in paragraph 9 (above). Tinker Tank may also need to share your personal information with external organisations, such as credit bureaus, tax authorities or other regulatory or industry bodies, so that we can meet our due diligence or regulatory requirements. We may need to share your personal information with our business partners or counterparties, where we are involved in corporate transactions relating to the sale or transfer of any of our businesses, legal entities or assets, or to any party to whom we assign our rights under any of our agreements for particular products and services.

- Tinker Tank will not share your personal information with third parties who do not need your personal information, or where Tinker Tank is not legally permitted to do so. When Tinker Tank decides to transfer your personal information to third parties, we will only provide it to organisations that have data privacy policies equivalent to Tinker Tank ’s, or subject to appropriate contractual obligations, or to those who are subject to laws relating to the processing of personal information that are similar to those that apply to Tinker Tank .
- There may be instances where Tinker Tank will process your personal information through a secure automated tool, or perform profiling and make decisions, based on such profiling. If you are unhappy about the outcome of such a decision or would like further information on how such outcome was reached, please contact our numbers below:
- As a customer of Tinker Tank we may use your personal information to tell you about products or services we think you might be interested in.
- Should you not wish to receive direct marketing communication from us, you can immediately update your preferences via our website, app, by getting in touch with our contact centre or with a service representative at any of our offices.

- As a non-customer, if you would like to know more about Tinker Tank’s products or services, please submit your details to us in writing.
- We will adhere to your communication preferences whenever we can, but we may need to send you important communications via a channel that is not your preference. We will only do so in cases where we deem the information to be important and relevant for you.
- To the extent that local legislation permits or if you are a resident of the European Union or United Kingdom, you have the following rights regarding your personal information:
- You have the right to ask Tinker Tank to correct any of your personal information that is incorrect. These requests must be sent to us in writing using the information below
- You can ask Tinker Tank to delete or destroy your personal information. You can also object to Tinker Tank processing your personal information. These requests must be sent to Tinker Tank in writing. However, the result of such a request will be that Tinker Tank may have to suspend the provision of products and/or services for a period of time, or even terminate our relationship with you. Tinker Tank’s records are subject to regulatory retention periods, which means that Tinker Tank may not be able to delete or destroy your personal information immediately upon request.

- You may also ask Tinker Tank to port your personal information to another party in terms of applicable laws or object to Tinker Tank processing your personal information for the purposes of profiling in terms of applicable laws. These requests must be sent to us in writing.
- If you have a complaint relating to the protection of your personal information, including the way in which it has been collected or processed by Tinker Tank, please contact us using the local contact details as listed below. If you have not had your complaint dealt with satisfactorily, you may lodge a complaint with your local privacy regulator in terms of applicable privacy laws.
- Tinker Tank reserves the right to change this statement at any time. All changes to this statement will be posted on the website. Unless otherwise stated, the current version shall supersede and replace all previous versions of this statement.

Changes to these Terms and Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy become effective when they are posted on this page.

Payments, shipping and cancellations

Payment terms for compliance with a total (VAT included) value
Shipping. Local shipment is done through Paxi (available across Pep stores throughout South Africa while international shipping is done using Postnet (postnet.co.za) charged at a flat fee of R115 (see item code "24011" ). Arrival times are dependent on courier. Clients in Gauteng province, South Africa are except from shipping fees.

Refunds. All refunds emanating from cancellations (where applicable) must be concluded in writing, within 5 working days from date of service commencement. All cancelled services attract a 10% administration fee. To be eligible for a refund, all items must be unused, i.e. not having been registered or used to apply for business tools from other business providers or state entities, otherwise it would invalidate the return. Certain services are exempt from being cancelled. To complete your refund process, proof of payment and reason for cancellation are required. Once all required documentation is received a refund will be processed and the amount will be credited to your account by way of EFT within 48 hours.
